QUEENS, N.Y. – According to a NY Daily News report, a 21-year-old woman claims to have been raped by a man who later texted her and called her trying to establish a relationship and get a date with the victim.

The report reads that in early March of 2009, 26-year-old Timothy West broke into the Applebee’s waitress’ home through a window and raped her twice at knifepoint, once with a condom and once without protection.

After the rape, West allegedly demanded food, then asked for her contact information saying, “Maybe we can be friends?”

The woman reported that she obliged, hoping he would call so she could alert the police.

A few hours after her rape, West reportedly texted the victim, casually asking, “What’s up girl?”

The victim ended up speaking to West on the phone and a recording of the conversation was played in court during her case against West Thursday, October 21.

The victim asks , “You just broke into my house, yo. I’ve never seen you before …. You try to rob me, then you rape me. Why you did that to me?”

“I do apologize from the bottom of my heart,” he told her.

He then asks: “You mad at me?… I can’t call you no more?”

“What made you want to come in and break into my house? Why out of all the houses, why my house?” she questions.

“It was just random,” he replied.

“Can I come see you?” he asked.

In the remainder of the phone conversation, West apologized for the rape.

A meeting was arranged at Dunkin Donuts, where the victim waited with the police, and West was promptly arrested when he arrived.

West’s sordid criminal history includes arrests for robbery and burglary. He said the sex was consensual. He faces up to 25 years in prison if convicted.

The trial is ongoing.
