According to a petition filed by the victim, Herbert Smith, a judge sentenced him to 60 years in jail over driving with a suspended license. Judge Matthew Destry, who supposedly has a history of over sentencing people of color, sentenced Mr. Smith and his family wants him removed from the bench. Upon further investigation of the situation Mr. Smith also violated probation and was charged with possession of a weapon by a felon. Do those charges validate a 60 year sentence?
